“Clean Break” Consent Order Fees 2012
What is a clean break order?
An agreed clean break consent order is an order by agreement at the end of your divorce which dismisses both your own right and that of your spouse to make any future claims against each other arising out of your marriage. This means that you will no longer have the right to claim maintenance for example or for a share of the other’s pension.
For the purposes of this fixed fee agreement a “clean break” consent order does not contain any other provisions such as transfer of property or maintenance and pension sharing. For consent orders which contain any other provisions than standard clean break clauses our standard consent order fee is payable. When can a court make this type of order?
The court requires certain financial information before a consent order can be made. This information needs to be provided in a document called a “statement of information for a consent order” on or after pronouncement of your decree nisi.
The court has no power to make this type of order before decree nisi but can make it at the same time as pronouncement of the decree or at any time after that.
Who is it suitable for?
This type of order is only suitable in cases where:
a. there are no joint assets or savings (either because you did not buy any property together in the first place or because they have been sold and the proceeds already divided)
b. there are no joint debts
c. it is agreed that there will not be any maintenance paid either now or in the future (except maintenance for a child which is being dealt with either voluntarily or by the CSA) and
d. it is agreed that no assets, such as savings, life policies, individually owned property or pensions are going to be transferred from one of you to the other or sold, whether now or in the future, and the proceeds shared.
What is included in the £275 plus vat fee for this service?
The fee of £275 plus VAT includes the following:
1. Advising you as to the legal effect of a clean break consent order.
2. Preparation of your order and the statement of information for a consent order.
3. Sending your documents to you for approval and signature.
4. Sending the documents to your spouse for approval and signature.
5. Sending the documents into court for approval by the Judge with a covering letter/statement in support with any background information that may be relevant.
6. Keeping you updated as to progress regularly by letter/email.
The fee is on the basis that you and your spouse are agreed on the clean break and cooperate fully in the approval and signature process and provide all financial information required to complete the statement of information form without delay when requested.
No face to face consultation is included in the fee quoted other than a routine meeting to enable us to advise you on the content of the draft order and obtain your signature. This may alternatively be done by post.
Additional fees are payable for face to face consultations or dealing with financial disclosure or other non-routine correspondence not included above. Should this become necessary we will inform you before carrying out any further work and explain why this is necessary.

Court fees
Court fees are payable by you directly to the court when the consent order is submitted to court.
Court Application fee £ 45.00
The £275 plus vat fee is for agreed clean break consent orders only and does not include any discovery or verification of assets (which is not provided voluntarily and without delay for the purposes of completing the statement of information as outlined above) or work in connection with the divorce petition itself or children issues.
