You must have been married for at least one year before you are permitted to commence divorce proceedings.
You may complete the forms but your application to court may only be submitted once you have been married for more than one year.
You must be able to prove that the courts of England and Wales have jurisdiction to deal with your divorce application. This is governed by Article 3 of the Council Regulation (EC) No 2201/2003 of 27th November 2003.
If you and your spouse are both habitually resident in England or Wales the court has jurisdiction.
The majority of people will probably find that they are habitually resident if they usually live in England or Wales. If in doubt please complete our domicile query form and email it to us before going any further.
If you and your spouse are not both habitually resident in England and Wales please read article 3 and select which option applies best to you. If you do not understand anything in relation to jurisdiction you are advised to use our standard solicitor service.
We will need a copy of your marriage certificate to prepare your divorce petition. If you do not have it please obtain an official copy from the place where you were married or from the general register office. We will ask you for it when we contact you to acknowledge your order and to request payment.

At Online Divorce we have 20 years experience providing professional help and advice at an affordable price in connection with the legal process of separation and divorce in England and Wales.
When we receive your instructions we will begin drafting your divorce petition and all supporting paperwork. We will contact you for further information as required.
If you choose our basic £75 LiP service we will send the completed paperwork to you with instructions on what to send to the court and when to do it.
If you choose our standard service we will deal with the court and your husband/wife on your behalf and make the applications for decree nisi and decree absolute for you at the correct time - subject to you providing us with the court fee for the decree absolute when requested.
Our information and advice guides (in our members area) will help you decide whether you need advice in relation to dividing your assets on divorce or having any agreement approved by the court and thereby made legally binding.
We can provide this advice but this is a separate service and separate charges will apply. You have no obligation to take any additional services.
Payment is requested once we receive the completed application form and check that you are eligible for a divorce under the law of England and Wales.
With the litigant in person (DIY divorce) service we will only be preparing the initial divorce application/petition for you. You will handle the rest of the divorce yourself with the assistance of our online divorce guides and support. If you would prefer us to handle the divorce from start to finish for you our standard divorce service might be more appropriate.

Refunds - If you change your mind before we have commenced work on your petition just let us know and you will not be charged for any preliminary paperwork checking. However, once we have begun work on your petition and requested payment a refund of our fee will not be made unless we have made an error. All overpayments and un-used court fees will be refunded. We are regulated by the Solicitors Regulation Authority and insured by Travelers professional risks. A written copy of our code of conduct and our complaints procedure is available on request.
