What Is An Undefended Divorce?
A divorce is undefended as long as
either
the respondent files an acknowledgement of service indicating that he/she does not intend to defend the proceedings
or
the respondent fails to file an acknowledgement of service but also fails to file a defence.
In addition, in adultery cases an admission of adultery will be required in order for the proceeedings to continue even if undefended.
In separation cases where consent is required, evidence of that consent must be provided in order for the proceedings to continue even if undefended.
In all cases the person bringing the proceedings to court must be able to prove that the other person knows about and has received a copy of the petition or in certain limited circumstances apply for an order for exemption from the court.
Bailiff service and additional applications to court are not included in our standard fee but can be arranged on request if necessary.
