D11 application for final order by respondent

Individuals (and legal advisers) can use this form to add your details to

a D11 form that has been adapted to apply for a final order of divorce by a respondent; and
a template draft order.

On submission of the form, you will be transferred to Stripe to complete a payment of £25.

You will receive by email:

The completed D11; and
The draft order

You (or your legal adviser) may make amendments or add further details to both documents on receipt.

Note:

Before you can apply for a final order of divorce as respondent, you must wait 3 months from the first date the applicant for the divorce can apply.

It is a good idea to discuss this with your spouse first.

The court service will list a hearing for this type of application. The applicant will be notified and will have a right to object.

The judge will decide whether there is a good reason to delay the final order of divorce. There must be special or exceptional circumstances or a risk of real prejudice to your spouse to delay the making of the order.

Everyone’s circumstances are unique. There is no definition of special or exceptional circumstances. This is up to the judge to decide in your case.

However, in previous cases, the court has decided that having to deal with financial issues/pensions is not necessarily special or exceptional.

The court can make a costs order at this type of hearing.

Court fee

If you are not eligible for help with fees, a court fee is payable when you make this type of application. From 13th July 2026 the fee is £195.
